These Terms & Conditions (“Terms”) govern your access to and use of the Homrz website, mobile applications, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.

If you do not agree, do not use the Platform.

1) Definitions

1. “Homrz,” “we,” “us,” “our”: the operator of the Platform.
2. “User,” “you”: any person using the Platform.
3. “Buyer”: a User purchasing products/services.
4. “Seller,” “Vendor,” “Merchant”: a User offering products/services for sale.
5. “Content”: text, images, reviews, listings, designs, and other materials.
6. “Order”: a purchase transaction placed through the Platform.

2) Eligibility and Accounts

You must be at least 18 years old (or the legal age in your country) to use the Platform.

You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account.

You agree that information you provide is accurate and up to date.

3) Platform Role

Homrz is a platform that enables Buyers and Sellers to connect.

Unless explicitly stated otherwise, Homrz is not the seller of items listed by Sellers and does not own or control listed products.

Homrz may provide tools for payments, communications, logistics integrations, and dispute support, but Sellers remain responsible for their listings and fulfillment.

4) Listings and Seller Responsibilities

Sellers must:

1. Provide accurate product details (pricing, availability, specifications, photos, delivery time, and applicable restrictions).
2. Ensure products are lawful, safe, and compliant with applicable regulations.
3. Fulfill Orders promptly and professionally.
4. Honor return/refund obligations as required by law and these Terms.

Homrz may remove listings or suspend Sellers for policy violations, misleading content, intellectual property infringement, or repeated complaints.

5) Orders, Pricing, and Payments

1. Prices are set by Sellers unless Homrz is explicitly the merchant of record for a specific item.
2. You authorize Homrz and/or its payment partners to process payments and related fees.
3. Taxes, shipping, customs, or duties may apply depending on location and will be shown where applicable.
4. If a payment fails or is reversed, the Order may be canceled or suspended.

6) Shipping, Delivery, and Returns

Delivery times are estimates. Sellers are responsible for packaging and dispatching Orders.

Returns/Refunds depend on:

1. The Seller’s return policy (as shown on the listing/store page), and
2. Applicable consumer protection laws.

Some items (e.g., customized/handmade-to-order, perishable, or hygiene-related goods) may be non-returnable where legally permitted and clearly disclosed.

7) Cancellations

1. Buyers may request cancellation before an Order is shipped/processed (subject to Seller acceptance and listing terms).
2. Sellers may cancel Orders only for valid reasons (e.g., out of stock) and may face penalties or reduced visibility for repeated cancellations.

8) User Content (Reviews, Photos, Messages)

You retain ownership of your Content, but you grant Homrz a non-exclusive, worldwide, royalty-free license to host, use, reproduce, display, and distribute it for operating and improving the Platform.

You must not post Content that is illegal, defamatory, infringing, misleading, hateful, or harmful.

9) Prohibited Activities

You agree not to:

1. Use the Platform for unlawful purposes.
2. Provide false information or impersonate others.
3. Upload malware or attempt to disrupt the Platform.
4. Scrape, reverse engineer, or exploit the Platform.
5. Circumvent fees, payments, or platform processes.
6. Infringe intellectual property rights.

10) Intellectual Property

Homrz’s name, logo, trademarks, design, and platform software are owned by Homrz or its licensors and may not be used without written permission.

11) Fees and Commissions

Homrz may charge service fees, commissions, subscription fees, or payment processing fees. Applicable fees will be disclosed in Seller dashboards, onboarding, or checkout where relevant. Homrz may update fee structures with notice as required by law.

12) Disputes Between Buyers and Sellers

We encourage Users to resolve issues directly. Homrz may, at its discretion:

1. Request evidence (photos, tracking info, communications),
2. Facilitate communication,
3. Provide a proposed resolution,
4. Apply account actions for policy violations.

Homrz is not obligated to decide disputes unless required by law or explicitly offered via a protection program.

13) Disclaimers

The Platform is provided “as is” and “as available.” To the maximum extent permitted by law, Homrz disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.

Homrz does not guarantee that listings, Sellers, or products will meet your expectations.

14) Limitation of Liability

To the maximum extent permitted by law:

1. Homrz will not be liable for indirect, incidental, special, consequential, or punitive damages.
2. Homrz’s total liability for any claim related to the Platform will not exceed the amount of fees you paid to Homrz in the 3 months before the event giving rise to the claim (or a minimum amount required by law).

Some jurisdictions do not allow certain limitations; in that case, the limitations apply to the extent allowed.

15) Indemnification

You agree to indemnify and hold harmless Homrz from claims, damages, losses, and expenses arising from your use of the Platform, violation of these Terms, or infringement of rights.

16) Suspension and Termination

Homrz may suspend or terminate accounts at any time if:

1. You violate these Terms or policies,
2. You create risk or legal exposure,
3. Fraud, abuse, or harmful behavior is suspected.

You may stop using the Platform at any time.

17) Privacy

Your use of the Platform is also governed by our Privacy Policy. (Publish a separate Privacy Policy page and link it here.)

18) Changes to These Terms

We may update these Terms from time to time. We will post the updated version and update the “Last updated” date. Continued use after changes means you accept the updated Terms.

19) Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction where Homrz operates (to be specified). Disputes will be resolved by competent courts in that jurisdiction unless consumer protection laws require otherwise.
